In 2026, the Indiana State Congress wrote legislation to make homebuyers more informed about real estate referral fees. The legislation started as House Bill 1252. The bill passed and was signed by the Governor. The law will be codified as IC 25-34.1-10-18 and go into effect on July 1, 2026.
The text of Indiana’s real estate referral law states: “A broker company who refers a client or customer to another broker company shall disclose to the client or customer if the broker company may be compensated for referring the client or customer. The disclosure must be made in writing and be provided to the buyer at the time of the referral.”
Unfortunately, more details, such as the amount of the referral is not required to be included. Instead, the referring broker just needs to provide disclosure that they will receive a referral fee. More sadly, so many consumers will just sign without reading a thing and unnecessarily commit themselves to higher and higher fees.
How to Avoid the Zombie Brokerages
